Setting aside / Recourse against Arbitral Award

Since an Arbitral Award is similar to a Decree of a Civil Court, civil courts generally do not interfere with the Award except in some exceptional situations.

  • Incapacity
  • Change of Law
  • Irregularity of Artbitral Proceedings - such as not giving proper notice etc
  • If Award differs from the dispute
  • Composition of Arbitral Tribunal
  • Subject matter of dispute / problem cannot be settled by arbitration
  • Conflict with public policy: Inducement, Fraud, Corruption, Confidentiality, Rule of Evidence etc
  • Time limit
  • Procedure by Court
