Act 10 of 1994

An Act to provide for the constitution of a National Human Rights Commission, State Human Rights Commissions in States and Human Rights Courts for better protection of human rights and for matters connected therewith or incidental thereto.

Be it enacted by Parliament in the Forty-fourth Year of the Republic of India as follows:-

Sections of the Act

Chapter I: Preliminary

  • 1. Short title, extend and commencement
  • 2. Definition
  • 2(d): "human rights" means the rights relating to life, liberty, equality and dignity of the individual guaranteed by the Constitution or embodied in the International Covenants and enforceable by courts in India;
  • 2(f) "International Covenants" means the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights adopted by the General Assembly of the United Nations on the 16th December, 1966;

Chapter II: National Human Rights Commission

  • Section 3: Constitution of a National Human Rights Commission
  • Section 4: Appointment of Chairperson and other Members
  • Section 5: Removal of a Member of the Commission
  • Section 6: Term of office of Members
  • Section 7: Member to act as Chairperson or to discharge his functions in certain circumstances
