Domestic Award

In an Arbitration proceeding, an Award passed under the provisions of Section 2 to 43 of Arbitration and Conciliation Act, 1996 is called a Domestic Award.

  • These are disputes between parties of nations and within the country.
  • This part does not apply to foreign awards and international commercial arbitration.
  • For disputes other than International Commercial Arbitration and the place of arbitration is India, the Arbitral Tribunal shall decide the dispute in accordance to Substantive Law for the time being in force.
  • For disputes other than International Commercial Arbitration but belongs to domestic commercial arbitration, the dispute shall be decided based on substantive and municipal laws. i.e Limitation Act, 1963 applies.
